gurus..inputs plz!
did my first MS, got First OPT ...worked on OPT..didnt find a job..
went back did my second MS..got another OPT...and moved into non-quota H1 (research field at a hospital)
now plan to go back and get an MBA..
1.) will i get an OPT after my (fulltime) MBA??? (as i already have 2 OPT's)...is there a limit of OPTS?
2.) Since i was a non-quota H1..will i have to apply for the quota H1 when and come out of MBA...which is basically a lottery system now!!! (and if i dont hit the jackpot that will put me out of status immediately after )
any inputs are appretiated!!

Hello all,
My EAD expired in late April
Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).
I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.
If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?
How do employers handle something like this?

8th Year H1 extension applied by current company. Still in process, should be approved in Nov 2006.

There is nothing tricky, it is plain and simple: you want to switch jobs?
You have to apply for a new H1. You absolutely cannot use your current H1 to work any other job.

This question is for an attorney:
My spouse's case is this: She has applied for AOS I-485 (India) based on an underlying EB3 I-140 (PD feb. 2007) petition during July 2007. At that time she had also applied for an EB2 NIW self petition, which was recently approved in April 2009.
Two issues arise now:
a) The PD date of the newly approved I-140 is August 2007.How do we inform USCIS to capture previously approved EB3 I-140's PD. She has used AC21 to port to same or similar job, but he previous EB3 I-140 has not been revoked. Is it possible to capture previous PD?
b) Do we have to send new I-485's or can we ask USCIS to interile newly approved EB2 NIW I-140 to the already submitted I-485s. If yes, how do we do that ?

I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

If I remember correctly, if your I-140 is "approved" and if your I-485 is pending for more than 180 days, then it "should not" be matter whether your I-140 is revoked or not.
In your case, if you get RFE (what for????) , just send the AC21 letter and you will be fine.

From what I have heard from close friends/relatives, your option B is correct.
Also, people living abroad and coming here and getting citizenship is only possible as you know if they fulfill the physical presence and continuous residency requirements. Further, since they have a US address (and can provide proof for it), why should the 90 days USCIS district requirement be an issue?!

I've had my D100 for about 3 years. I noticed that the frame buffer was getting lower and lower - and I thought it was just that my memory card was getting old... but I just bought a new one and that was not the problem.
I used to get 6 or 7 images in the buffer, and now it's just 2.
Is there a fix for this or does it need to be repaired?

This morning I received USCIS email alert for both my wife and I.
My I-485 application got a RFE. "We mailed you a notice requesting additional evidence". Will have to wait for the formal letter for the details. :(
My wife's I-485 application however was transferred to Newark NJ for interview. "This case has been sent for a standard interview." :confused:
I have a ton of questions at this stage. here are few in you gurus can help me while I am waiting for the RFE letter.
1) Will the RFE letter be mailed to me or my attorney ? what has been ur experience? do you get it in one week ?
2) why USCIS has split the processing of my I-485 and my wife's I-485. Her I-485 is transfered to Newark, NJ while mine is pending at TSC (now waiting for RFE response).

Hi, Today my I485 had a LUD and when I check the status it is saying:
Document mailed to applicant.
On October 24, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
I already received everything and went for FP 20 days ago. I missed the appointment and then went the next friday and they took the prints. I was told that I didn't need to reschedule the FP. I had the LUD after the FP date too.
I have seen that someone had this same status but did anyone ever receive nay other document in mail?? IF so what is it???
