I saw this guy on CBS 60 minutes and it was truly inspirational. He is not just an "Immigrant of the day" but an great intellect.

yes - I think the only difference is that you cannot use the approved AP to come in.
If you use H1B to enter u shd be ok... dont try to come in with the AP

same with me. I was the only one to be recruited after months of efforts.
Now they started my LC with Manager's approval. Lawyer is doing the same thing.

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. I am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

I did my masters in US and have got my H1 B status which expires next year. Had a few question. Just to add to my situation i have not got my H1 stamping done on my passport.
Q1. Can i apply for an extesion without a visa stamp.
A. Yes, you can. You only need stamp if you leave the US.]
Q2. How early can i apply for an extenstion.
A. Within 6 months from the first date of the H1 period.

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??
You can still claim the PD of your old I-140. Once an I-140 is approved PD is yours to keep for life.

My H1B visa end date is 30July2013(PED or expiration date in H1B visa stamp) and my I-94 end date is 10-Aug2013.But in I797B the end date is 30July2011. You've been approved per your message below. So all it means in your case is that the USCIS has to let the Visa Center and/or Dept of State know that.

Today Immigration Customs and Enforcement ("ICE") (http://www.ice.gov/pi/nr/0909/090910elcentro.htm) announced an arrangement with Imperial County Sheriff's Department in which individuals during the booking process will have their biometric data checked with Department of Homeland Security ("DHS") data and FBI data to determine whether or not they are in the United States illegally. When a person's fingerprints match those of someone in DHS' biometric data system, ICE is automatically notified. It wouldn't hurt your GC process or your status even if your employer revokes your approved I-140. If you are so worried then check this info from USCIS - http://www.uscis.gov/files/pressrelease/I140_AC21_8403.pdf
